1. User Agreement

By accessing and utilizing the services provided by Mountaintop 360 ("we," "us," or "our"), you ("Client" or "User") agree to be bound by these Terms of Service. This agreement sets forth the legally binding terms and conditions for your use of our lead generation, inbound call routing, and appointment setting services. If you do not agree with any part of these terms, you must discontinue use of our services immediately.

2. Service Description

Mountaintop 360 provides specialized growth and acquisition infrastructure for contracting businesses. Our core services include:

  • Inbound Call Handling: We manage advertising campaigns to route high-intent, exclusive local calls directly to your designated business lines.
  • Lead Qualification: Our team captures digital lead submissions, filtering out non-qualified inquiries based on agreed-upon criteria before they reach your sales team.
  • Appointment Setting: We proactively contact generated leads and schedule qualified estimates or consultations directly onto your business calendar.

We reserve the right to modify, suspend, or discontinue any aspect of these services at any time, with reasonable notice provided to active clients.

3. Limitations of Liability

To the maximum extent permitted by applicable law, Mountaintop 360 shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from (a) your access to or use of or inability to access or use the services; (b) any conduct or content of any third party on the services; or (c) unauthorized access, use, or alteration of your transmissions or content. Our total liability for any claims under these terms is limited to the amount you paid us for the services in the three (3) months preceding the claim.

4. Intellectual Property

All landing pages, ad copy, branding assets, software, and proprietary systems created by Mountaintop 360 remain the exclusive intellectual property of Mountaintop 360 unless explicitly transferred in a written agreement. Clients retain full ownership of their pre-existing trademarks, logos, and business names provided to us for use in the advertising campaigns. Upon cancellation of services, clients must cease the use of any proprietary landing pages or systems hosted and managed by Mountaintop 360.

5. Termination

Either party may terminate this agreement at any time by providing written notice. Upon termination, Mountaintop 360 will cease all active advertising campaigns and lead generation efforts on your behalf. Any outstanding invoices for services rendered or leads delivered prior to the termination date must be paid in full within 14 days of termination. We reserve the right to suspend or terminate accounts immediately for violation of these terms or non-payment.

6. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Lancaster County, Pennsylvania, and the parties hereby irrevocably consent to the personal jurisdiction and venue therein.
